Did you know that zoning changed on all properties in Albuquerque when the City adopted a new zoning code? Is the change complicating a sale? Here’s some good news; The City of Albuquerque is offering a free process until April 2019 for sellers and future property owners to convert their zoning for any of these reasons:
1. To bring properties with nonconforming uses into compliance with the new zoning code.
Example: To convert zoning from MX-T to MX-L for a property with self-storage.
2. To downzone residential properties to match the existing use on the property.
Example: To convert zoning from R-ML to R-1 for a property with a home.
3. To establish 1 zone on a property with 2 zones (i.e. “a floating zone line”).
Example: To convert to MX-M a property with both MX-L and MX-M.
4. To convert zoning to what the owner wants for undeveloped properties that used to be zoned Special Use (SU-1, SU-2, or SU-3) or R-D.
Example: To convert to NR-C to allow light industry in an appropriate area.
5. To convert zoning to what the owner wants for properties zoned NR-BP or PD that do not meet size thresholds in those zones.
Example: To convert from NR-BP for properties < 2 acres and not within a Master Development Plan or from PD for properties < 2 acres or ≥ 20 acres
Planning staff can help you figure out whether a property you are helping to buy or sell meets any of these criteria. To participate in this free process, property owners must sign and submit a form by April 15, 2019.
